PERIOD OF THE PROGRAM:
1. The Mountain
Timbers Rewards Program will be ongoing, commencing 1st July 2008 and
will be reviewed every 12 months.
ENROLMENT AND ELIGIBILITY:
2. Enrolment in the program will be by
invitation from Mountain Timbers Pty. Ltd. to professional builders and
contractors who have a trade account in-addition to COD Account
customers of Mountain Timbers Pty. Ltd. Participation in the program
will only apply after an official Registration Form has been completed
by a customer and/or company’s Principal and accepted by Mountain
Timbers Pty. Ltd. There is no cost to register in the MOUNTAIN TIMBERS
REWARDS program.
3. If a Contractor's business is conducted under a
partnership or by a company, the partners or directors must nominate a
person to be the representative for the partnership or company in the
MOUNTAIN TIMBERS REWARDS program. All awards will accrue to the
nominated representative.
4. If a Customer's business changes hands
during the program, the outgoing proprietors may, subject to the
approval of Mountain Timbers Pty. Ltd., retain any awards accrued to
that date. The incoming proprietor may be invited to register for the
remainder of the program subject to the Rules & Conditions set out in
this document upon the incoming proprietor's completion of a new
Registration Form and acceptance of the new Registration by Mountain
Timbers Pty. Ltd.
5. The MOUNTAIN TIMBERS REWARDS program does not
constitute an offer capable of acceptance by any person resulting in a
contract or any other legally binding agreement. Rather, the submission
of a completed Registration Form will constitute an offer by the
Customer to participate in the program, subject to acceptance by
Mountain Timbers Pty. Ltd.
6. To be eligible to receive awards during
the program, the participant’s trading account Mountain Timbers Pty Ltd
must be maintained within the terms of their trading agreement.
MOUNTAIN TIMBERS REWARDS POINTS:
7a. Participants earn Points by
purchasing products from Mountain Timbers Pty Ltd.
7b. MOUNTAIN TIMBERS
REWARDS Points will be credited to the participant's MOUNTAIN TIMBERS
REWARDS account at the ratio of 10 Base Points for every $100 worth of
purchases through Mountain Timbers Pty Ltd. An additional 2 Bonus Points
for every $100 of purchases during the current month will be applied to
all account payments settled within 30 days trading terms. (excludes COD
Account Customers).
7c. MOUNTAIN TIMBERS REWARDS Points will not become
available for use until AFTER the participant has achieved a minimum of
150 worth of points. If a participant does not achieve 150 points by the
end of the program, any Points accrued to that date will become null and
void.
7d. MOUNTAIN TIMBERS REWARDS Points will be assessed on the total
invoiced value of ALL Products less any goods for returned credit (GST,
warranty and delivery charges, industry or Government levies which shall
be excluded from the invoice value of Products).
7e. Purchases that
result from special negotiations or tender quotations where the purchase
prices are below the customer’s current price structure as at 1st July
2008 are excluded from the program unless otherwise agreed. Mountain
Timbers Pty Ltd may also deem some products as non-qualifying, excluding
them from the program.
7f. Mountain Timbers Rewards reserves the right
to correct errors made to a Participant’s account at any time and will
inform Participant of any changes by mail, fax or e-mail.
7g. MOUNTAIN
TIMBERS REWARDS reserves the right to audit and verify invoices for
authenticity and accuracy at any time. All invoices and other documents
that a Participant submits to MOUNTAIN TIMBERS REWARDS will become the
property of MOUNTAIN TIMBERS REWARDS and will not be returned. MOUNTAIN
TIMBERS REWARDS assumes no responsibility for invoices, reports or other
documents that are delayed, lost or stolen in the mail.
7h. Any accounts 60 days + : Membership will automatically be suspended
with all points accrued to date forfeited. Once payment is received
their membership only will be re-activated.
7i. Any accounts 90 days + : Membership will be cancelled with no
eligibility to rejoin the program.
7j. All Points Earned up to 2009 – Points earned between 1st July 2008
and 31st December 2009 must be redeemed prior to 30th June 2011. Any
unused points after this date will become null and void. All Points
Earned during a calendar year commencing 2010, are valid for an 18 month
period. Any unused points after this period will become null and void.
For example; Points earned between 1st January 2010 and 31st December
2010 must be redeemed prior to 30th June 2012.
AWARDS:
8a. MOUNTAIN TIMBERS REWARDS Points can be used to
purchase travel or merchandise items as described in the MOUNTAIN
TIMBERS REWARDS brochure and website. Points shown in the brochure are
current at the date of publication and are subject to change.
8b. The
number of MOUNTAIN TIMBERS REWARDS Points required for travel
arrangements will be based on the best available package price at the
time of booking.
9. MOUNTAIN TIMBERS REWARDS Points are not transferable
and cannot be exchanged for any other form of award such as cash, stock,
settlement of accounts etc.
10. Travel awards must be booked and
finalised prior to departure. Requests for travel packages must be
received a minimum 45 days prior to anticipated travel date and all
travel arrangements are subject to availability at the time of booking.
11. Participants may supplement their MOUNTAIN TIMBERS REWARDS Points
with payment in order to obtain a higher value Award when they have
insufficient MOUNTAIN TIMBERS REWARDS Points to purchase the desired
holiday or merchandise item. This Points shortfall will be confirmed
upon confirmation of the order.
12: MOUNTAIN TIMBERS REWARDS reserve the
right to alter, delete, add or substitute any awards that are offered as
part of the MOUNTAIN TIMBERS REWARDS program as they deem desirable from
time to time and accepts no liability of or incidental to the removal.
TAXATION:
13. Any liability for Commonwealth, State or other
taxes imposed on any prizes resulting from this program will be the sole
responsibility of the recipient and not Mountain Timbers Pty. Ltd.
Participants should refer to their own taxation adviser.
RESPONSIBILITY:
14. Mountain Timbers Pty. Ltd. does not accept
any responsibility or liability whatsoever for any loss, accident,
injury, delay or irregularity or consequential damages that may be
caused to any person or persons or to property in connection with any
services or travel arrangements resulting from the MOUNTAIN TIMBERS
REWARDS program.
FINAL DECISION AND TERMINATION:
15. Mountain Timbers Pty Ltd may
terminate the MOUNTAIN TIMBERS REWARDS program at any time by providing
notice to Participants at least 45 days in advance of the termination
date. Such notice may include posting the notice of Program termination
on Mountain Timber’s rewards website. Participants will have until the
termination date to use all accrued but unused Points after which time
they are void.
16. Participants who act in a manner that is inconsistent
(deceptive, misleading, illegal or unethical practice) with these Rules
& Conditions of the MOUNTAIN TIMBERS REWARDS Program; or Participant
acts in a manner that Mountain Timbers Pty Ltd reasonably believes may
have an adverse effect on its reputation in the community. Accrued but
unused Points will be forfeited and the Participant will be terminated
from the MOUNTAIN TIMBERS REWARDS Program.
17. Mountain Timbers Pty Ltd
reserve the right to amend (change, delete or add) the terms of the
MOUNTAIN TIMBERS REWARDS program, as they deem desirable. Mountain
Timbers Pty Ltd will provide notice to participants via post or online.
Unless otherwise indicated, amendments will apply to any Points accrued
and/or an awarded in the future of the program.
18. The MOUNTAIN TIMBERS
REWARDS program is conducted subject to these Rules and Conditions and
any other details outlined in the program announcements or subsequent
communications and all participants agree to be so bound. In all matters
relating to the interpretation of any rule or phase of the program the
decision of Mountain Timbers Pty. Ltd. will be final and binding on all
participants.
Additional
Terms and
Conditions
The
Mountain Timbers Rewards programme is operated by
NGT Travel Conferences Incentive (Level 5, 606 St Kilda Road, Melbourne
Victoria 3004 - "NGT"). NGT
undertakes to operate Mountain Timbers Rewards to the best of its
ability for and on behalf of Mountain
Timbers Pty Ltd (Cnr Liverpool Road and Chandlers Lane, Kilsyth,
Victoria 3137).
Whilst commissioned to deliver Mountain Timbers Rewards, NGT acts
in the capacity of Mountain Timbers
Pty Ltd and in no way
represents, or is in any way responsible for, any action
or consequence of action by that sponsoring client
related to the Mountain Timbers Rewards Programme.
NGT
is not responsible for "use-by-date"
restrictions or any other conditions placed by any
voucher suppliers, and the programme participant is
obliged to comply with these restrictions. All gift
vouchers are irreplaceable in the event that they are
lost. No refunds or substitutions will be available for
lost vouchers.
NGT
reserves the right to vary the Mountain Timbers Rewards programme
rules, and the right to cancel or change any award at any
time, without recourse.
NGT
will choose the method of delivery.
Any
Programme Participant found to be acting fraudulently may
be expelled from the Mountain Timbers Rewards programme without
recourse, and may have all his/her/their points
forfeited. Any costs to NGT as a direct consequence of
fraudulent action brought about by Programme Participant
may be recovered by NGT from the Programme Participant.
Points
may only be redeemed for those rewards described in the
Mountain Timbers Rewards programme. Rewards include only the item
described and do not include installation, licenses,
training or any other aspects which could be associated
with usage.
All
Programme Participants' personal information provided for
the purpose of an Mountain Timbers Rewards programme will be used
for that programme only and not for any other purpose.
The Programme Participant's information will be stored on
secure computer discs and will be destroyed at the
conclusion of the programme. Personal information will
not be conveyed to a third party except for the expressed
purpose of reward delivery.
The
recipients of rewards are subject to Australia law. Any
changes in Australia law, taxes or levies will be
implemented as per legislative directive.
If a reward is not
available at time of redemption, another reward of equal or slightly
different value may be substituted. Programme Participants will be
advised and may amend their redemption selection under these
circumstances.
Mountain Timbers
Rewards reserves the right to send Programme Participants
messages relating to the programme, such as: monthly
points' statements, administration notices, product
specials, system updates, order confirmations, delivery
notices, etc.
The
Programme Participant agrees to advise Mountain Timbers Rewards of
any delivery address or email address change.
NGT
reserves the right to modify Mountain Timbers Rewards at any time
with or without notice to Programme Participants.
NGT
shall not be responsible for any damage or loss to data
as a result of unauthorised interference with its
computer data storage and programme implementation
system.
All
notices by NGT will be deemed delivered by email, by mail
or by facsimile.
